(MIAMs)

MIAMs Law Passed

From the 22nd April 2014, any person wishing to get a divorce or separation, who is wanting to use the court system to solve any issues about their children or finances, must demonstrate that they have been to a separate Mediation Information Assessment Meeting (MIAM), prior to applying to the court for a court order.

MIAMS How Does It Work?

How does a MIAM work? The two people will usually be invited to separate private meetings; the applicant (the person asking the court to get involved) will almost always have to go to the meeting; the other person is expected to go, but does not have to unless the court says this must happen. At this point your mediator will advise how many more sessions you will require if any, and what will be discussed at those sessions. As well as any associated costs.

Time

Research undertaken into national audit figures of legally-aided mediation's, compared as follows; it took just over three months to complete a mediated case. Opposed to a year and two months for a court to decide on similar matters.

Stress & Mental Health

Family disputes of any nature can be stressful, unpleasant and emotionally draining, and are usually all three and more; divorces and separations are typically messy and highly emotional situations to have to go through. Our family MIAM trained mediators can assist you resolve all of your issues cost effectively and as quickly as possible.

Online MIAM Service

We can conduct your MIAM in person or through online video conferencing platforms such as Zoom, WhatsApp, Skype, and Facetime. This is just as effective as having a MIAM in person. Not only will this save you time and money, we can schedule appointments outside of office hours, to suit your needs.

Costs

Costs: Mediation can be much more cost effective than court action. Research indicates that the average cost per client of mediation can be up to one sixth of the cost, when compared to going through court.

Free MIAMs

If you are out of work, or on certain benefits you may be entitled to free MIAM’s. Your mediator will advise on whether you qualify or not, or what your total cost will be, before you enter into mediation.
