Our Glasgow Mediation Services Have Helped

This mediation was pre litigation, proceedings were on the cusp of being served. The Housing Association (THA) leased various properties to a Limited Company. (LC).  There were two written leases, the first between the THA & the LC, dated in 2019, and the second dated in 2023, as well as a small number of unwritten leases proceeding under the same terms as the written leases (collectively referred to as “the Leases”). The majority of the leased properties were covered by the written lease dated in 2019.

In early 2023, the THA intimated its intention to increase the rent payable by the LC under the Leases. Who queried the proposed increases in April 2023. A consultation process took place during May 2023. THA Management Committee elected to continue with the rent increases as follows. One bed rooms would increase by £180.46 a month. Two bed rooms would increase by £300.67 a month. And three bedrooms would increase by £376.55 a month.

The LC disputed the validity of the rent increases. Separately, THA terminated the Leases by Notices to Quit served in latter part of 2023. The Leases terminated on in January 2024. The LC refused to leave the properties, and had taken no steps THA was aware of to re-house the occupants. The LC contends the Leases were not terminated until the current occupants were re-housed by the LC. The mediation took place in person, and took some seven hours.
