Landlord Tenant Mediation

Landlord tenant mediation services. Today I am explaining how I took an enquiry for a commercial dispute, concerning a landlord and tenant mediation, from start to finish. How long it took to arrange, mediate and how it was settled.

£8,000 Rent A Month

Paying a rent of nearly £8,000 a month, having paid upfront £89,400 for a year, quite understandably the claimant was extremely angry and upset. In the end the claimant broke the lease using a break clause & gave 2 months’ notice to quit. Thereafter the claimant instructed solicitors to claim back some of the rent she had paid for the distress she went through & misrepresentation of the property.

Initial Enquiry

On the 29th April 2024 the claimant’s solicitor called asking for a quote to mediate a landlord and tenant dispute. The issues revolved around the property being in severe disrepair, not as advertised, and continual issues whilst the tenant was in occupation.

Defendant's Solicitor

The defendant’s response was clear, although there were some minor issues, they were nothing like the claimant had described. Equally any issues which arose were taken care of immediately, and in accordance with the terms of the short-term tenancy lease signed by both parties. The dispute commenced in October 2021, so had been going on nearly 3 years.

Timeline For Landlord Tenant Mediation Services

Client Calls

On the 29th April 2024 the claimant’s solicitor called asking for a quote. We discussed the dispute. I confirmed by email my costs and dates of availability. Advising I could mediate for them in eleven days’ time. On the 24th May 2024, the claimant’s solicitor responded.

Instructions Updated

They now had instructions, and asked for my up-to-date availability. I was in Canada at the time, for an international mediation concerning, properties and a family business. I replied and gave further dates, with my first opening being eight days later.

More Dates

On the 10th June 2024 the claimant’s solicitor asked for my July dates, I replied with the 1st of July, being my first opening. On the 19th June 2024, both the claimants and defendant’s solicitor advised their clients could mediate on the 1st July 2024.

Paperwork Issued

It took me one hour to generate the paperwork, I issued my instruction letter, agreement to mediate and my invoices on the same day. On the 20th June 2024 the defendant’s solicitor rang me, and asked if we could rearrange the mediation date, due to her going on annual leave.

New Date

Asking for the 10th July 2024, the new date was agreed with all. On the 8th July 2024 I received the signed agreements to mediate, position statements, mediation bundle, and payment. It took me two hours to read through the 341-page bundle.

The Mediation

On the 10th July we had eight hours to mediate, I led the parties to a settlement in five hours, the dispute had been going on for nearly three years. Yes, it did take me ten weeks to mediate, however this was down to the parties and their legal teams’ commitments, I initially offered to mediate within eleven days of contact.

£60 - £80,000 Saved

I saved the parties in the region of £60,000 - £80,000 in legal fees. It would have cost both parties circa £20,000 each to take this to trial and a final hearing. The defendant had a letting agent who was in charge of marketing the property, and dealing with any repairs. Therefore had this matter continued, the defendant would have joined them to the proceedings as a Part 20 claimant / defendant.

The agent would have more than likely have got their insurers involved, who would have become party to the dispute. There two parties would have also incurred £20,000 each in legal fees. On this mediation, with the parties consent I had three mediation observers, who found the whole experience fascinating, watch the video in full to hear what they had to say.

Out comes a Paul Smith. The parties have had a tiff.

A Valentino tie which is yellow. The dispute was extremely acrimonious, and not mellow.

Tenant and landlord via the zooms. Dispute is over arrears and disrepairs of all the rooms.

The Rado watch was on the wrist. Another settlement on my success list.

Pre litigation correspondence through solicitors for three years. I settled it in five hours, in front of three of my mediation observer peers.

I mediated a boundary dispute for the defendants law firm previously in June two thousand and twenty three. Two settlements on two separate matters for a reasonable mediation fee.
