M had one of the Asylum Accommodation and Support Services Contracts (AASC) with the Home Office by which asylum seekers (which M refers to as “service users”) are provided with accommodation and support in Scotland pending the determination of their asylum claims.
Pursuant to this, both M Group PLC entered into leases of various residential properties in Glasgow with an Housing Association. In total, 85 properties were let to M for 185 asylum seekers.
The dispute was still in the pre-action phase and was not yet subject to Court proceedings.
The two principal issues were firstly, the rent for all the properties let to M were increased by 64%, 91% and 104%. This was disputed and refused, rent arrears accrued as a result. The mediation took place in person, and lasted seven hours.
