What Is Early Neutral Evaluation ?
Early Neutral Evaluation (ENE) is an alternative dispute resolution (ADR) process used to facilitate the settlement of legal disputes.
ENE is commonly used in civil cases, including family law, commercial disputes, employment issues, and other types of litigation. It can help parties clarify the key issues, reduce legal costs, and foster settlement by offering a realistic view of the case's potential outcome.
Non-binding Evaluation
The opinion is non-binding but provides an unbiased evaluation on relative positions and guidance as to the likely outcome should the case be heard in Court.
And may offer a recommendation for settlement. The parties must agree the nature and extent of the material to be provided to the evaluator and whether there are to be oral submissions..
How Does It Work?
Early neutral evaluation is a preliminary assessment of facts, evidence or legal merits. This process is designed to serve as a basis for further and fuller negotiations, or, at the very least, help parties avoid further unnecessary stages in litigation.
The parties appoint an independent, impartial third party, typically an experienced solicitor, judge or retired judge, who listens to the facts and legal arguments from both sides early in the case. After reviewing the case, the evaluator provides an opinion on the merits of the issues brought before them. To include an assessment of the strengths and weaknesses of each party's position
Neutral Characteristics
The evaluation happens early in the litigation process, often before significant costs have been incurred. The evaluator offers an objective, independent opinion on the likely outcome if the case were to proceed to trial.
The process is confidential, meaning the evaluation and the discussions held during ENE typically cannot be used in court if the case continues. The evaluation is advisory and not enforceable. Parties are free to accept or reject the recommendations. ENE is designed to help parties resolve disputes more quickly and economically, often encouraging settlement before further legal proceedings.
