The claimant issued proceedings against the defendant for £200,000. Following the transportation of the claimants specialist equipment. Which was severely damaged whilst in transit. There was a previous part 36 offer to accept £130,000 plus costs.
The Claimant’s insurer had no wish to put the Defendant into liquidation and recognised its cashflow crisis. The claimant was prepared to allow a recovery period, following which, tax efficient staged payment of settlement could be made. The mediation was via online mediation, and took four hours and settled.
