What Is Med Arb ?
Med – Arb commences with a traditional mediation involving the assistance of a trained mediator. If an agreement is reached that is an end to the matter.
Med Arb Sessions
Either immediately at the close of the mediation, or at an agreed later date, the arbitrator takes evidence from the parties and renders a binding arbitration award (decision).
What Types Of Disputes?
If the parties cannot resolve the matter, (having agreed before the Med – Arb commenced), they can ask the mediator to change roles and to become the arbitrator.
Mediate Or Arbitrate?
Another effective dispute resolution process. However, it has been criticised it's been argued that how can the same person who is initially independent, then make a judgement to make an award?
