What Is Mediation?
There are so many different definitions of what mediation is. The majority of these definitions are similar but will vary slightly on who you ask the question to. The Law Society, the Oxford & Cambridge dictionaries, the Civil & family Mediation Council all define it in their own words.
Long story short, mediation is a way of assisting any one person or entity who is in dispute with another person or entity to resolve their dispute. Mystery solved, that is it!
However, I say forget the, or a “mediation meaning”. As one of the UK’s most experienced mediators with over 2000 mediations under my belt and 23 plus years of experience, I ask my clients, those that I mediate for, “what do you want mediation to mean to you?”
A question I sometimes get no answer to or a range of answers to. This is what I believe mediation should mean to any potential user, especially a client of mine. This is what they should expect from me, and actually get.
- I want my mediator to listen to me and understand everything I have been through and help me to end my dispute.
- I want them to guide me through every stage of the mediation process and make me feel safe. Yet be realistic with me and firm if and when required.
- I want them to be fair and not to take sides. I want them to stamp out any unfairness and bullying from the other side and or their legal team.
- I want them to be professional but to treat me as a human being, and not just another case.
- Not to pressure me to stay, nor push me towards a solution I would not be comfortable with.
- I want to get value for money. Get what I paid for, even if the mediator cannot lead us to a solution. Knowing they did all that they could to facilitate a solution would still be a good result.
How can mediation help me?
An independent and accredited trained mediator like myself leads the parties in dispute towards a solution that works for all concerned. I do this through a series of private and joint meetings, which take place over the course of half a day, a whole day.
Initially I just introduce myself go through my formal essential mediation opening, explain what my role is. What the process will entail. Then I slowly but surely move the parties through the exploration, (question, answer, explanation and venting stage), negotiation, agreement and settlement stages.
Throughout each stage I do the talking, but also encourage the parties to talk to one another as well as direct to me.
Is a face-to-face mediation more effective than online mediation?
The answer to this is yes and no. It will depend upon several things. Some disputes need to be mediated in person and would benefit from having the face-to-face interaction. Generally, the personalities of the parties, the type of dispute it is, the complexities involved will all dictate whether online mediation should be used over an in-person mediation.
